Satisfaction of conditions

This page outlines the process for satisfying conditions for all types of major developments.

If your original application was not a major development, submit your request as a Post Submission of Additional Documents (PSAD) using your original planning application reference number on the eDevelopment portal. You must ensure that a Document Schedule for satisfaction or discharge of conditions is submitted alongside your documentation through the portal, using a separate line for each condition. 

Services we provide

To satisfy conditions for major developments we offer a Priority service (with a fee) and a Standard service (with no associated fee)

Priority service - after receiving and validating your submission, we will respond within 6 weeks.

There is a fee for this service. For more details on how much you need to pay check our planning fees page. To assist with calculating how much you need to pay use the planning fee calculator and our planning application charges. You can pay using our planning and building standards payment form.

Standard service - after receiving and validating your submission, we will respond within 3 months. There is no associated fee.

How to apply

Complete our Apply for Satisfaction/Discharge of Conditions form. Either print and post or email a copy to our eProcessing Centre (details below). Wait for your new reference number from us so that you can upload all documentation through the eDevelopment.Scot portal using the blue ePlanning button. You must ensure that a Document Schedule for satisfaction/discharge of conditions is submitted alongside your documentation via the portal using a separate line for each condition. 

If you are applying for our Priority service, please make sure you make payment before submitting your form. Your application will not be valid until payment has been received. For more information on other ways to pay, please visit our Planning Payment options page.

Categories of conditions

  1. Pre-commencement
  2. Construction
  3. Pre-occupation
  4. Operational

While each condition varies, usually pre-commencement and pre-occupation conditions need information to be submitted to the Planning Authority for approval before the development can move to the next stage. This process is known as satisfaction of conditions.

Discharge of conditions can only happen once the development has been completed in line with approved details. Generally, operational conditions cannot be discharged.

Once you have applied

There is a legal requirement to send us a Notification of Initiation of Development before you start development on site. You should only submit this once all pre-commencement conditions have been satisfied.

Development can only start once we have advised you that all conditions are satisfied.
