As a Highland Council employee or worker, your information is processed to enable employees and managers to be treated fairly and be supported in line with HR policies and procedures, whilst ensuring compliance of the Equality Act, the Employment Rights Act, the Working Time Regulations, the Trade Union Act and the Rehabilitation of Offenders Act.

This may include information relating to:
• Criminal Offences
• Health
• Person’s sex life or sexual orientation
• Political opinions
• Racial or ethnic origin
• Religion or philosophical beliefs
• Trade union membership

We will not be able to employ you if you dont provide personal data and we would not be able to carry out our statutory duties in relation to employment.

Contract - we need to process this personal information to fulfil our contract with an employee (Article 6(1)(b) of GDPR).
Special categories of data relating to employment are processed under Article 9(2)(b) of GDPR.

In line with relevant legal obligations, we sometimes need to share your information with other organisations, such as

There may be occasion when the following organisations require to process information on our behalf:
• ACAS
• Counselling providers
• Disclosure Scotland
• Employment Tribunal Offices
• External mediators
• GTCS
• Occupational Health Provider

• Solicitors
• Trade Unions

Your data is held for the duration of your employment plus six years and then deleted. If you work with children or vulnerable adults your data is held for the duration of your employment plus 25 years.

Your personal information is not subject to automated decision making or profiling.
