Description
We are responsible for the receipt and verification of building standards applications. We are also responsible for ensuring compliance with the Building Scotland Act 2003 and The Building (Procedure) (Scotland) Regulations 2004. We process these applications both electronically on the eBuildingstandards.scot portal in line with the The Building (Miscellaneous Amendments) (Scotland) Amendment Regulations 2017 and in paper.
Verifiers are appointed by Scottish Ministers and The Highland Council is the appointed verifier for its geographical area. Our role as verifier is to protect the public interest by providing an independent check of applications for building warrants to construct or demolish buildings, to provide services, fittings or equipment in buildings, or to convert buildings.
The building warrant application form (online and paper version) also asks for your consent to participate in a national customer satisfaction survey for building standards.
Personal information such as name and contact details of the Owner is needed to administer this process.
In addition to our current role as verifier, we have to maintain a register (in two parts) of the applications for warrant and amendments to warrant, including the plans, other documents and information submitted, together with the decisions taken on the applications.
Part I is an electronic record and consists of a list of applications including details of any certificates from approved certifiers and decisions and copies of notices served under sections 25 to 30 of the Act when issued, altered or withdrawn.Part 2 consists of copy building warrants, copy completion certificates, copies of any certificates from approved certifiers submitted in support of building warrants or completion certificates, principal drawings and specifications, and all other documents submitted to the local authority for registration in the building standards register. -
If you don't give us your information
If you don't provide the necessary personal information, we will be unable to process your application and take payment for it.
If you don't provide consent to take part in the National Customer Satisfaction Survey we won't provide your details to the Scottish Government.

Legal Obligation - The Council is required by the Building Scotland Act 2003 to maintain a register which includes the details of owners. (Article 6(1)(c) of GDPR)

Who we share your information with
As part administering this process, we do not pass on the personal information to any other organisations.However, we are required under the Building (Scotland) Act 2003 to make Part 2 of the Building Standards Register (where personal information is held) available for public inspection for a minimum of 25 years – we may hold details for up to 50 years should there be a valid basis for doing so.
If you do give consent to participating in the National Customer Satisfaction Survey for Building Standards, this documented consent is transferred into our back office system along with all other application details (via a connector if submitted online) and then provided back to Scottish Government, who will then make contact with you.

How long we hold your information
Part I of the building standards register shall be maintained by the local authority for all time.
Part 2 of the building standards register shall be retained by the local authority for a period of 25 years and thereafter for such period as the local authority having regard to any guidance issued by the Scottish Ministers considers reasonable. -
