Purpose
An Asset Transfer Request is the formal document in which a Community Transfer Body applies to take-over management or ownership of a Highland Council Asset. -
Description
In January 2017, the Community Empowerment Act extended communities' powers to participate in the delivery of services and take over management and ownership of Assets. The process through which communities can take-over Assets is described as Community Asset Transfer. Submitting a full Asset Transfer Request allows the Highland Council to assess a Community Transfer Body's application. The information provided in the Asset Transfer Request will determine the Council's decision on whether to transfer an asset.

If you don't provide the mandatory information and supporting evidence on the Asset Transfer Request, we will be unable to assess your application.

Conditions for processing personal information
The Council is processing your data as part of the Asset Transfer process as set out in the Community Empowerment Act. Therefore, processing is necessary for the performance of a task carried out in the public interest [Article 6(1)(e) of GDPR].

Who we share your information with
The contact details of the Community Transfer Body you represent, the contact details of the person submitting an Asset Transfer Request and the details of the Asset Transfer Reuqest may be shared with relevant stakeholders depnding on the Asset. Relevant stakeholders may include: the Highland Council Owning Service, High Life Highland, other public authorities (such as NHS Highland or Police Scotland); Highlands and Islands Enterprise, Development Trust Association Scotland, Highland Third Sector Interface, the Scottish Government.
In-line with the Community Empowerment Act legislation, copies of full Asset Transfer Requests must be made available to the public to view. Therefore, redacted copies of Asset Transfer Requests and other supporting documents will be made available for download on the Highland Council website. Members of the public will also be able to view copies of these documents at the closest Service Point to the Asset.

How long we hold your information
Your informatio will be held for 3 years after your stop using the service. Details of any Asset Transfer which occur will be logged for longer, without personal information.
