Short Term Let Control Areas
Control Area - Badenoch and Strathspey (Ward 20)
The Badenoch and Strathspey (Ward 20) Short-term Let Control Area comes into force at 12pm on Monday 4 March 2024. The entire Ward 20 area is covered by this requirement, a map of ward 20 can be downloaded.
After this date, planning permission is required before a dwellinghouse (as defined in the Act and Regulations) where the owner does not reside in the property is rented out for short-term let. These planning applications will be determined in accordance with the Council adopted Development Plan and Non-Statutory Short-Term Let Control Area Planning Policy.
Ahead of the Short-term Let Control Area introduction, the Council ran several Information Sessions to advise the industry and affected communities of the changes the Control Area brings about. The Online Information Session is available on the Council YouTube Channel. The Council has also made available a Guidance Note which provides advice for existing and new operators.
Short-term Let Operators also require a licence to operate and further advice on the requirements, including how to apply is available on the Short-term Lets page of the Council webpage.
The Council has received a large number of applications for planning permission and certificates of lawfulness across Ward 20, as a result of the proposal to create the Short-term Let Control Area and the obligations for operators under The Civic Government (Scotland) Act 1982 (Licensing of Short-term Lets) Order 2022. The Council will shortly be contacting applicants directly to explain the options and process moving forward.
