Restrictions on Evictions
Under the Cost of Living (Tenant Protection) (Scotland) Act 2022, several restrictions have been placed on landlord’s ability to evict their tenants.
When do tenants need to leave their property?
Tenants do not have a legal responsibility to leave their rented property once the Notice to Quit or Leave period has ended. They may remain in the property until a landlord has secured an Eviction Order from the Property and Housing Chamber (also known as the First Tier Tribunal for Scotland). This applies to all evictions regardless of the grounds and tenancy types.
We will advise tenants to remain in their property until an Eviction Order is secured.
Notifying us
Local authorities must, by law, be notified of any households facing the threat of homelessness through eviction or repossession.
The aim of a Section 11 Notification is to prevent homelessness by allowing us to contact affected households with an offer of support. Failure to comply can result in challenge. It can be taken into account when considering an application for landlord registration.
Landlords are expected to try and resolve issues debt and of anti-social behaviour prior to taking action to evict tenants.
