1. Apologies for Absence
Apologies for absence were intimated on behalf of Councillor MacNab.
2. Confirmation of Minutes
The Minutes of the Meeting of the Licensing Board held on 16th March and Adjourned Meeting held on 13th April, 2004, copies of which had been circulated, were held as read and were unanimously approved.
3. Caithness Drugs and Alcohol Forum
The Chairman welcomed Mr. Robert Sutherland and Mr. Robert More, from Caithness Drugs and Alcohol Forum, to the meeting and invited them to address Members and licensees on the work of the Forum.
With the aid of a Powerpoint presentation, the two gentlemen described the work of the Forum, particularly its work with young people and the various initiatives in which it is involved. The Chief Inspector explained that the four strands to the work of the Forum are Enforcement, Education, Communication and Treatment. Following the presentation Mr Sutherland and Mr More answered questions posed by Board members and the members of the public in attendance at the meeting. The Forum members agreed to speak to any licensees regarding the work of the Forum.Councillor Flear thanked the Forum members for their contribution to the meeting.
4. CHILDREN'S CERTIFICATES - REVIEW OF CONDITIONS
There was circulated to Members for consideration three responses which had been received to the consultation letter sent to all licensees of hotels and public houses in Caithness in connection with the Board's review of the conditions attached to children's certificates. Responses had been received from Robert Reynolds of Portland Arms Hotel, Helen Hill of Nethercliffe Hotel, and the Scottish Licensed Trade Association. A copy of the letter to licensees, and the standard Children's Certificate conditions were also circulated.
Mrs Sinclair explained the reasoning behind Children's Certificates, the Board's power to impose and review conditions and the requirement for conditions to be enforceable. In particular, the Board noted that before the conditions could be amended, there would require to be further consultation with the holders of children's certificates.
After discussion, the Board agreed to propose the following amendments to the existing conditions:
Delete Condition 1, and substitute: "The section of the premises to which the Children's Certificate applies shall be a designated non-smoking area and where that section is part of a larger room where smoking is permitted, the licence holder shall ensure that suitably designed extractor fans or similar devices are installed to prevent smoke from entering the certificated area."
Delete Condition 2, and substitute, "Children are only permitted in the part of the licensed premises to which the certificate relates, and must at all times be accompanied by a person of not less than eighteen years of age."
Delete Condition 3, and substitute: "Any open fire or heating appliances in the premises or part thereof shall be fitted with a guard sufficient to prevent any injury to any child who might come into contact with it."
Add to end of Condition 6, "Any amusement machines with prizes located in the certificated area must be switched off during the hours that the certificate is in force.''
Add to beginning of Condition 9, "Baby changing facilities must be adequate and must be accessible to adults of both sexes."
Mrs Sinclair undertook to write to the holders of children's certificates and to those who had responded to the consultation with details of the Board's proposed amendments, and to report back to the next meeting of the Board.
