Privacy notices - Freedom of information

In order to respond to your requests under the Freedom of Information (Scotland) Act 2002 and the Environmental Information (Scotland) Regulations 2004, the Council must process your personal data.  The council will keep records of your request and its response. 

The type of personal data processed will be your name and contact details and any information you provide with your request.

We will not be able to process your request without processing your personal data.

Legal Obligation.  The Council is legally obliged by the above legislation to respond to your requests and must process personal data to do so. (Article 6(1)(c) of GDPR).

Where your request relates to information received from other organisations, the Council may contact these organisations regarding your request, if it is appropriate to do so.  We do not identify the applicant when consulting, but in some cases it is difficult to maintain anonymity.

We will share information with the Scottish Information Commissioner if you appeal to them about the Council's response to your request.

Records of FOI / EIR requests will be retained for 3 years.

Your personal information is not subject to automated decision making or profiling.
